Other than the 60 day express warranty for repair or replacement, Wholesale Tool disclaims any warranty including implied warranties or warranties of fitness for a particular purpose unless the state in which the product is sold prohibits such disclaimer in which case any minimum warranties provided by law in that state shall apply. This disclaimer shall not affect the purchaser from making a warranty claim with a manufacturer whose warranty exceeds sixty (60) days.

Purchaser's damages shall be limited to the repair or replacement of the defective item and seller shall not be liable for consequential, special, or incidental damages, and in such case damages shall be limited to the minimum damages allowed by law in the state where the product is sold. No allowance shall be granted for repairs or alterations made by the purchaser without our prior written consent. The decision to repair or replace shall be at the discretion of Wholesale Tool Co. Any damage caused by the use of static phase converters on 3 phase machines may affect your warranty.

Purchaser agrees that any action for damages shall be brought in Michigan unless the state in which the product is sold prohibits venue requirements in sales transactions.
